1.1. The term "Zimazon", "us", "we", "our" refers to the owner of the website whose registered office is 155Williams Way, Msasa, Harare, Harare, Zimbabwe.
1.2. The term "you" refers to the user, viewer, customer, client or guest of our website.
2.1. Unless inconsistent with the context, an expression which denotes:
2.1.1. Any gender includes the other genders;
2.1.2. A natural person includes a juristic person and vice versa;
2.1.3. The singular includes the plural and vice versa.
2.2. If there is any conflict between the provision of these Terms and Conditions and the Contract Data, the provision of the Contract Data shall prevail.
2.3. The clause headings shall not limit, alter or affect the meaning of the Terms and Conditions.
3.1. Governing law, Law governing the Terms and Conditions shall be the law of the Republic of Zimbabwe.
3.2. Language, The language of the Terms and Conditions and of all communications between the Parties shall be English.

4.2. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

4.8. Your use of this website and any dispute arising out of such use of the website is subject to the Governing Law of these Terms and Conditions, see Article 3 Subsection 1.
4.9.1 By confirming an order during the checkout process you are acknowledging that you have purchased the item(s), and that you agree to honor the amount detailed in the total, to be payable to Zimazon.
4.9.2 You may cancel an order within a 12 hour period from the initial order time, once this window has passed you have acknowledged that the order is correct and that you will honor the payment upon delivery.
4.9.3 You acknowledge that in the event of an Online Payment, Zimazon as a Online Merchant will redirect you to a trustworthy and certified financial institution for Payment and Verification, at which point if the Financial Institution verifies payment from you to Zimazon, your order will be placed and will be considered final.
4.9.4 You acknowledge that shipping and or handling fees may be added during the checkout process, these fees will be visible and will require your confirmation.
4.9.5 Delivery times given by Zimazon to the customer are an estimate and are subject to change without explanation, we will advise the customer if the package is delayed, however we are not obliged to offer an explanation.
5.1. Without prejudice to any other rights of the customer under these conditions, Zimazon warrants that:
5.1.1. All Goods delivered will be free from defective materials or workmanship;
5.1.2. This warranty shall survive any inspection, delivery, acceptance or payments by the customer;
5.1.3. The Goods will remain free from defects for a period of one month (unless otherwise stated in the Terms and Conditions) from acceptance of the goods by the customer.
5.2 Assessment and Reimbursement
5.2.1 The cost of exporting the good(s) for warranty assessment will be for the account of the customer.
5.2.2 If the good(s) are found to be defective and are within the warranty by the international supplier of the good(s), the cost of the export will be refunded to the customer by Zimazon, and the replacement good(s) sent to the customer free of charge.
5.2.3 In the event of a dispute between the customer and Zimazon concerning the defective good(s), a third party will be nominated by Zimazon to identify the root cause of the damage/defect, See Article 5 Subsection 3.2
5.3.1 Good(s) that are defective in a way not related to manufacturer defect or shipping accident, will not be considered for warranty or warranty assessment.
5.3.2 Root cause of defect will be at the sole discretion of Zimazon, Zimazon will give the customer the benefit of the doubt, however within reason.
5.4 Good(s) that are found to be covered under the Zimazon warranty will be sent to the supplier for warranty evaluation.
5.5 Zimazon will not be held liable for a supplier defaulting a warranty.
5.6 You the customer agree that by confirming an order, your good(s) may be delivered in a state that will require warranty evaluation and assessment.
5.7 We reserve the right to defer an order to recover costs if payment is not made within seven days of delivery, this does does not apply to Bank Transfer, Online Payment, but only to Cash On Delivery
Terms & Conditions - legacy as of 02/06/2011
By completing an order, you (the customer) agree to honour the payment requirements upon delivery of your goods.
An order may only be cancelled 12 hours from the time the order was placed, after which the order has been processed and cannot be cancelled.
Shipping costs are factored into your order during checkout.
The cost specified on the site www.zimazon.co.zw during checkout is the final cost to you (the customer). A separate invoice will be emailed to you detailing local Zimbabwean taxes such as VAT. (Please note these taxes are all factored into the price you see on www.zimazon.co.zw) and will display slightly differently on your invoice. Zimbabwean VAT is also factored into the cost you see on Zimazon. The price you see on the site is the price you pay. (Please note, Zimazon is not currently VAT registered)
Shipping times are estimated at 7 to 14 working days but may be longer in the event of Zimbabwean ZIMRA processing delays which are out of our control.
All goods are sold with a standard 1 month warranty.
The cost of exporting the goods for warranty assessment will be for the account of the customer. If items are found to be faulty and within warranty by the international supplier of the goods, the cost of the export will be refunded to the customer, and the replacement item sent to the customer free of charge.
Faults or damage caused by anything other than faulty manufacturing are not covered in the warranty, for example electricity spikes, damage through miss use or acts of God.
